FTW PERKS Membership Terms & Conditions

1. Definitions

In these Terms:

  • "FTW PERKS", "we", "our", "us" means FTW PERKS PTY LTD (ABN 62686929573), of 5930 Obley Road, Yeoval NSW 2868.

  • "Member", "you", "your" means any person who holds an active FTW PERKS membership.

  • "Platform" refers to the FTW PERKS website (www.ftwperks.com), mobile site, and any affiliated social media or online services.

  • "Membership" means your subscription to any FTW PERKS tier as described in Section 4 of these Terms.

  • "Benefits" includes exclusive content, discount offers, giveaways, events and promotions offered to Members.

  • "Giveaway Terms" means specific rules applicable to each promotional campaign or giveaway, as published separately.

  • "GST" refers to Goods and Services Tax under A New Tax System (Goods and Services Tax) Act 1999 (Cth).

2. Nature of Membership Services

2.1 FTW PERKS memberships provide access to exclusive digital content, community features, partner discounts, and automatic entry eligibility into promotional giveaways (“Membership Benefits”).

2.2 Giveaway entries are complimentary components of an active membership and do not represent a separate purchase or paid entry. For the purposes of giveaway eligibility, ‘active membership’ means an uncancelled, paid membership at the time of the draw. Members who cancel their membership will continue to have access to digital membership benefits until the end of their current billing period (as managed via your FTW PERKS account), but will not be eligible for any giveaways conducted after their cancellation date.

2.3 One-off promotional access or entry offers, when available, are also considered digital services under this Policy and are governed by the same terms.

2.4 Membership Delivery and Third-Party Platforms. FTW PERKS memberships are delivered and managed via third-party platforms, including subscription management systems, payment processors, and website hosting services. 

While we aim to ensure these services operate smoothly, FTW PERKS is not responsible for technical errors, outages, delays, or service interruptions caused by third-party providers.

Members are responsible for maintaining accurate account details and managing their membership through their account dashboard.

2. Acceptance of Terms

2.1 By subscribing, purchasing a membership, or using FTW PERKS services, you agree to be bound by these Terms, our Privacy Policy, the Website Terms of Use, and any applicable Giveaway Terms.

 2.2 If you do not agree to these Terms, you must not subscribe or continue your Membership.

3. Eligibility

3.1 Membership is open to Australian residents aged 18 years or older.

3.2 You must have legal capacity to enter binding contracts.

3.3 You warrant that all information provided during registration is true and accurate.

4. Membership Tiers and Fees

4.1 FTW PERKS offers three tiers of membership:

  • For Now: AUD $9.99/month: Includes 20 entries per giveaway period, exclusive email content and discount offers.

  • For Real: AUD $24.99/month: Includes all “For Now” benefits, plus access to additional giveaway information and 50 entries per giveaway period

  • For The Win: AUD $47.99/month: Includes all “For Real” benefits, plus access to additional giveaway information and 150 entries per giveaway period

4.2 The number of entries allocated to each membership tier applies to each giveaway conducted during the member’s active membership period.

4.3 All fees include GST and will automatically renew at the end of each billing cycle (monthly or yearly, depending on the plan selected) unless cancelled.

4.4 FTW PERKS reserves the right to vary prices or benefits with 14 days’ notice.

4.5 Optional Bonus Giveaway Entries. From time to time, FTW PERKS may offer bonus giveaway entries as a promotional reward or optional digital add-on. These bonus entries may be:

  • Automatically applied for new members as a welcome offer during select promotional periods, or

  • Available for optional purchase via the Members Portal, exclusively for active FTW PERKS members.

Purchasing bonus entries is not required to access any part of the membership or to be entered into giveaways. All active members are automatically included in giveaways according to their tier and existing eligibility. 5. Payment and Processing

5.1 Payments are processed via secure third-party payment gateways. FTW PERKS does not store your full card details.

5.2 Failed payments may result in suspension or cancellation of your Membership.

5.3 You authorise recurring charges unless or until you cancel your Membership.

5.4 All payments are processed securely via third-party payment providers. FTW PERKS is not responsible for errors, delays, or failures caused by third-party payment providers.

6. Conduct and Use

6.1 You agree not to:

  • Harass, abuse or discriminate against others;

  • Exploit the platform, giveaways, or content unlawfully;

  • Upload harmful code or impersonate others;

  • Misrepresent yourself or interfere with FTW PERKS systems.

6.2 Breaches may result in cancellation of your Membership without refund.

7. Changes to Membership Terms

7.1 We may modify these Terms or membership benefits by giving 14 days’ written notice via email or your member dashboard.

7.2 If you disagree with changes, you may cancel and receive a pro-rata refund for any unused fees.

7.3 Continued use of the Platform after the notice period constitutes acceptance of the updated Terms.

8. Cancellations and Refunds

8.1 You may cancel your Membership at any time via your account or by contacting us at admin@ftwperks.com.

8.2 Cancellations take effect at the end of your current billing cycle (monthly or yearly, depending on your plan). Refunds are not issued for partial months or unused terms unless required by law.

8.3 We may cancel your Membership if:

  • You breach these Terms and fail to remedy the breach;

  • Payment fails on two consecutive occasions;

  • FTW PERKS discontinues the Membership program.

9. Promotions and Giveaways

9.1 Entry into giveaways is automatic based on your active membership tier and subject to eligibility.

9.2 All giveaways are governed by separate Giveaway Terms, which must be read alongside these Terms.

9.3 Eligibility to win may be subject to state-based regulations and permit requirements. FTW PERKS reserves the right to exclude residents of certain states or territories where required by law.

9.4 Membership does not guarantee winning any giveaway or receiving any specific benefit. All prizes are awarded in accordance with the applicable Giveaway Terms.

10. Intellectual Property

10.1 All FTW PERKS content (including visuals, text, media, and tools) remains the property of FTW PERKS or its licensors.

10.2 You must not reproduce, share, or resell any content without express written permission.

11. Privacy

11.1 Your personal data is handled in accordance with our Privacy Policy.

11.2 By subscribing, you consent to receive communications from FTW PERKS. You may update your preferences at any time.

12. Liability and Consumer Guarantees

12.1 These Terms do not limit your rights under the Competition and Consumer Act 2010 (Cth).

12.2 To the extent permitted by law:

  • FTW PERKS excludes all warranties not expressly stated in these Terms;

  • Our liability is limited to resupplying the relevant service or refunding the fees paid;

  • We are not liable for indirect, incidental or consequential loss.

13. Force Majeure

13.1 FTW PERKS is not liable for failure to perform its obligations due to events beyond our control, including but not limited to pandemics, natural disasters, or internet outages.

14. Program Termination

14.1 We may discontinue the Membership program with 30 days’ notice. Any prepaid fees will be refunded on a pro-rata basis.

15. Governing Law and Dispute Resolution

15.1 These Terms are governed by the laws of New South Wales, Australia.

15.2 Any disputes must first be attempted to be resolved in good faith. If unresolved, both parties agree to mediation before initiating court proceedings.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, our Privacy Policy, and any applicable Giveaway Terms constitute the entire agreement between FTW PERKS and the Member.
