Effective as of: 1 July 2025

1. Promoter and Promotional Period

1.1 The “FTW PERKS July Giveaway – Dyson Airwrap + Prize Pack Promotion” (“Promotion”) is conducted by FTW PERKS PTY LTD (ABN 62686929573), of 5930 Obley Road Yeoval NSW 2868, trading as FTW PERKS (“Promoter”).

1.2 The Promotion commences at 9:00am AEST on Monday, 1 July 2025 and closes at 7:00pm AEST on Friday, 26 July 2025 (“Promotion Period”).

1.3 Entry into the Promotion is deemed acceptance of these Terms and Conditions. These Terms and Conditions apply to all eligible entries received during the Promotion Period.

2. Eligibility

2.1 Entry is open to Australian residents aged 18 years or over, who are current FTW PERKS members at the time of the prize draw, excluding residents of South Australia due to regulatory restrictions (“Eligible Entrants”).

2.2 The following persons are ineligible to enter or win a prize:

(a) employees, contractors, or directors of the Promoter or its related entities;

(b) immediate family members of those individuals listed above. “Immediate family” includes a spouse, de facto partner, ex-spouse, child or step-child (by birth or adoption), parent, step-parent, sibling, or step-sibling.

2.3 FTW PERKS membership is subject to the Membership Terms and Conditions, as amended from time to time.

3. How to Enter

3.1 Eligible Entrants will receive automatic entries into the Promotion based on the membership level held at the time of entry::

• For Now (Mini) membership – 2 entries
  
  

• For Real (Mid-Tier) membership – 5 entries
  
  

3.2 To validate entries, Entrants must also:

• Follow the official FTW Perks Instagram account @ftwperks; and

• Tag a minimum of three (3) friends in the comments of the official giveaway post on Instagram.

3.3 Entrants who fail to complete these steps may be deemed ineligible to win at the Promoter’s sole discretion.

3.4 New members who subscribe during the Promotion Period will receive entries immediately upon successful membership activation.

3.5 Only one membership per person is permitted. Duplicate accounts or fraudulent signups will void eligibility at the Promoter’s sole discretion. 

3.6 All entries are deemed received at the time of confirmation by the Promoter’s database, not at the time of transmission by the entrant.

4. Prizes and Total Prize Pool

4.1 The total prize pool is valued at AUD $1,019 (incl. GST) and includes:

First Prize:

• Dyson Airwrap Multi-Styler Complete Long

• Value: AUD $899
  

Second Prize:

• “Lil Treat” Prize Pack (curated beauty, lifestyle or wellness items)

• Value: AUD $60
  

Third Prize:

• “Late Night Lucky Dip” Gift Bundle (surprise items selected by FTW PERKS)

• Value: AUD $60
  

4.2 Prizes are not transferable, exchangeable or redeemable for cash unless otherwise stated.

4.3 If any prize is unavailable for any reason, the Promoter may substitute it with a prize of equal or greater value, subject to relevant approval.

4.4 If prize items differ slightly from advertised images or descriptions due to supplier availability or other unforeseen circumstances, the Promoter reserves the right to substitute components of equal or greater value. This applies to packaging, variations in colour, sizing, or brand of items included in curated or surprise prize packs. Every reasonable effort will be made to ensure the substituted item is of equivalent quality and intended use.

5. Prize Draw

5.1 The prize draw will take place at 8:30pm AEST on Friday, 26 July 2025 and be streamed live via the FTW PERKS Instagram page (@ftwperks).

5.2 Prizes will be awarded in reverse order of drawing:

• First valid entry drawn – Third Prize
  
  

• Second valid entry drawn – Second Prize
  
  

• Third valid entry drawn – First Prize
  

5.3 All winners will be contacted within 48 hours of the draw via the contact details on their FTW PERKS account. Results will also be published on FTW PERKS’ website and/or social channels.

5.4 If a prize remains unclaimed by 8:00pm AEST on Tuesday, 26 August 2025, a redraw will be held at 6:00pm AEST on Friday, 29 August 2025.

5.5 Any redraws will follow the same procedures. Redraw winners will be contacted and announced as per clause 5.3.

6. Prize Fulfilment and Delivery

6.1 Prizes will be shipped via tracked delivery to a nominated residential or business address within Australia. PO Boxes and parcel lockers are not accepted.

6.2 Winners must confirm their delivery and ID within 10 business days of being contacted. If delivery fails due to incorrect details, FTW PERKS will attempt redelivery but may forfeit the prize if unsuccessful.

6.3 FTW PERKS is not responsible for delays or damage once prizes are dispatched.

6.4 Prize Substitution & Security of Delivery, If, for reasons beyond the Promoter’s control, a prize or part of a prize becomes unavailable (including due to shipping delays, theft, damage, or discontinuation), the Promoter reserves the right to substitute the item with a similar product of equal or greater value. Prizes may also be delivered directly from a third-party supplier, and the Promoter takes reasonable steps to ensure the secure packaging and delivery of items. However, the Promoter is not responsible for loss, theft, or damage of prizes once they have left the possession of the courier or supplier.

6.5 Alternate Fulfilment Methods. In some cases, winners may be asked to collect prizes in person, or from a nominated pick-up location, particularly for high-value or sensitive items. This will be communicated to the winner at the time of notification. Identification matching the membership account may be required for release of the prize.

7. Use of Personal Information

7.1 Entrants’ personal information is collected for the purposes of administering the Promotion and future marketing.

7.2 By entering, you consent to this use in accordance with FTW PERKS’ Privacy Policy.

7.3 You can unsubscribe from future communications via the unsubscribe link in any promotional email. Transactional emails relating to the Promotion may still be sent.

7.4 The Promoter uses reasonable security measures, including secure data storage and access control, to protect entrant data. However, entrants acknowledge that no online transmission is entirely secure and provide their information at their own risk.

8. Publicity and Media

8.1 Entrants agree that FTW PERKS may use their name, image, or likeness to promote the Promotion without further compensation, unless they opt out in writing before prize acceptance.

8.2 Winners may be invited to participate in social media content, photos or other reasonable promotional activities.

9. Disqualification and Disputes

9.1 The Promoter may disqualify any entry that:

(a) is fraudulent, misleading or in breach of these Terms;
(b) tampers with the entry process or systems; or
(c) compromises the integrity of the Promotion.
(d) fails to complete all required steps for entry, including but not limited to following the official FTW Perks Instagram account or tagging the required number of friends in the giveaway post.

9.2 Disputes will be resolved in good faith. The Promoter’s decision is final, subject to regulatory oversight.

9.3 Prohibited Entry Methods. The use of bots, automatic scripts, or other software to fraudulently increase entries or manipulate the entry process is strictly prohibited. Any entrant suspected of engaging in such conduct will be disqualified without notice and may be reported to the relevant authorities.

10. Liability and Warranties

10.1 These Terms do not affect any rights under the Competition and Consumer Act 2010 (Cth).

10.2 To the extent permitted by law, FTW PERKS and its affiliates are not liable for any indirect loss, injury, or damage arising from entry or acceptance of a prize.

10.3 Entrants acknowledge that participation in the Promotion is at their own risk. To the extent permitted by law, the Promoter makes no representations or warranties regarding the availability, functionality, or delivery timelines of prizes, including where substitutions are required due to supply chain or availability issues.

10.4 Tax Liability. It is the responsibility of each winner to determine any tax implications that may arise from winning a prize. The Promoter is not responsible for any tax liability incurred as a result of prize winnings. Winners should seek independent financial advice if unsure.

10.5 Trade Promotions Regulations. This Promotion is conducted as a Trade Promotion under relevant Australian state legislation and does not require an entry fee or separate consideration beyond FTW PERKS membership subscription. The Promotion complies with the guidelines outlined by the Department of Fair Trading, particularly relating to promotional lotteries.

11. Force Majeure and Technical Failures

11.1 If the Promotion is disrupted due to a force majeure or technical fault, FTW PERKS may cancel, suspend or modify the Promotion.

11.2 “Force majeure” includes events outside the Promoter’s control, such as natural disasters, power outages, internet failures, or government restrictions.

12. Jurisdiction and Platform Disclaimer

12.1 These Terms are governed by the laws of New South Wales, Australia.

12.2 The Promotion is not affiliated with Meta, Instagram, TikTok or any third-party platform. Entrants release all such platforms from liability.

12.3 Complaints and Disputes Procedure. Entrants may lodge complaints regarding the conduct of the Promotion in writing to admin@ftwperks.com. The Promoter commits to addressing all complaints in a timely, fair and transparent manner. Where necessary, complaints may be escalated to third-party mediation or relevant consumer affairs bodies.
